Council, permits and defect reports in Aintree
Aintree sits in the City of Melton local government area, which oversees planning. Building permits in Victoria are issued by a registered building surveyor, who also manages the mandatory inspections and grants the occupancy permit. If your builder will not fix an issue, you can write a formal request, use the Building and Plumbing Commission dispute resolution service, and eventually go to VCAT. The Domestic Building Contracts Act 1995 and the statutory warranties in the Building Act 1993 apply here.

Planning and building
Council manages the planning permits. The building permit and stage inspections come from a registered building surveyor.
Occupancy permit
Issued by the building surveyor when the home is ready to occupy. It confirms the building meets the NCC, not that it is defect-free.
Defect notice
Send a written notice to your builder with the inspection report attached. State the defects and ask for a reasonable time to fix them.
BPC and VCAT
If the builder does not respond, contact the Building and Plumbing Commission dispute resolution service. You can then apply to VCAT.
Expert evidence for VCAT
VCAT requires an expert witness report. Our reports are written for you and your builder, but not specifically formatted for the tribunal.
